| [05-Oct-2022] During tenancy served an illegitimate 3 day notice to quit because he didn't understand bank processing times when impacted by a holiday. I am disabled with an assistance animal and the entire complex is pet friendly. I was referred to his unit by another property manager as we were forced to move during the pandemic, while I was unemployed and my daughter was just 3 days old. He was on vacation but kept a lock box on the front door with the key. Numerous texts asking about belonging left by previous tenants who terminated their lease early and I was told I could throw them away and other items were his and he asked me to set them aside. When he found out I had an assistance animal he decided it was an emergency and that I must've caused damage. I had been unemployed for 7 months and never missed a rent payment. I had an interview the day that was convenient for him and asked to reschedule a "general inspection" any other day (which wasn't required during COVID anyway). in the middle of my interview I hear a banging on the door followed by threatening language and he tried to use the key to enter. I had a renters deadbolt installed just for this reason. I let him know that it was not legal what he tried to do and never heard about it again. He sent a nonrenewal notice without cause but the neighbors informed me that he listed the unit for sale by owner. Same reason we had to move the prior year. As soon as I confirmed the date the movers would be there the listing for sale was removed. I asked if it would alright if I was out his property by noon on the 1st and he said sure he'd see me then. He came out screaming that I left the place filthy and there was garbage in the garbage cans. (extra boxes in the recycling bins he said they don't accept?) Neighbors overheard and came out in my defense and told him he was out of line. Thankfully they stood by my side and when he said "what are you still doing here?" They said "acting as witnesses should he need them". He then sent me an invoice for over $10K in repairs and also sent before photos. What he didn't know what that I pulled the metadata from the photos and they were from 2 years prior. he had no response. He billed for 70 hours of "general cleaning" @ $100 an hour by himself when he also has a full time job. I have photos proving otherwise, witnesses and have been putting a case together with my lawyer who reviewed everything and noted multiple violations with the FHA and HUD. When asked for receipts he provided 1 estimate and 1 receipt of the 12 items the invoice he sent me. He knows its all BS because when asked when he would receive payment multiple times I clearly said I wouldn't be paying and haven't heard anything back. If he was truly due that amount I'm sure I would've heard from his lawyer who he claims will beat any lawyer I could afford to hire. |
