[10-May-2012] Everything was fine June through April 2012. Jeannie Kitover took care of repairs and upgrades to plumbing, carpets, and appliances.
But in April 2012 Jeannie Kitover made demands that I water 24/7 open hose for one week. Full open hose is considered irrigation watering and is illegal in Rio Rancho after the Water Restrictions are in place April 1.
Jeannie made unfounded accusations about the condition of the landscaping and our watering. Her accusations sounded like threats about us paying for her landscaping. The trees and shrubs are at least 40 years old.
Jeannie made no mention of her expectations of that level of watering in the lease. We even asked her about watering the property prior to signing the lease and she said nothing. She was on the property several times prior to April and she made no mention of the condition of the plants or trees. Nothing was said until she went ballistic in April.
I tried to establish a mutually agreed upon watering plan with Jeannie Kitover, myself, and the Sandoval County Master Gardener's Club volunteers. They consult on appropriate landscaping and watering for the Rio Rancho micro-climate. Jeannie made no reply to my request for a walk through and watering plan.
During April Jeannie Kitover conducted a construction project on the property. She made no written notice of when she would be on the property. She used water that we paid for to water blast the roof siding. Her construction project filled our trash and recycling bins for 3 weeks (we pay for trash). And she worked around the property going beyond her reason to be there for the construction project. She also expected me to misrepresent myself as her to the City Inspector (I refused).
We received a Notice to Vacate in late April with no discussion of the watering conflict.
I do not feel that Jeannie Kitover entered our lease agreement in good faith. I believe that she knew that she wanted excessive watering in April and tried to bully us into it. She uses other people's resources for her benefit. Previous water bills show a $762 water bill in April 2010 under the tenants name.
If you rent from her demand that the water be kept in her name and that you pay a fair monthly amount that truthfully reflects your water usage. But, if it's not the water I believe that she would find something else to charge for. BEWARE. |
