[08-Nov-2012] Declan has a wonderful apartment property for rent in west mid-town Atlanta. While he was a good landlord in during our residence at his apartment, I was very astounded when he refused to refund our damage deposit. There were some spots in certain parts of the apartment that needed re-painting, as well as a few other disturbances that I do not believe was our fault. The ice machine's spout broke during normal wear and tear, yet he charged us out of our deposit to repair it. The wall of the spiral staircase was also pretty worn from moving furniture up and down the staircase. However, there is no other staircase to get the bedroom furniture up to the bedroom, so the fact that the only dings came from moving furniture up and down during move in sure seems like normal wear and tear to me.
What I think disappointed me the most was the fact that in the initial move-out inspection, Declan led me to believe I would be getting part of our security deposit back. When this did not happen, it took over a year of emails and phone calls to finally get my hands on the "invoices" proving the full amount of the security deposit. Most of the charges came from "billing" Declan's part in the repair process at $20-$25 an hour (depending on the particular repair work). I was astounded to see the actual breakdown of the "costs."
Case in point - if you plan on renting from Declan, be very sure that you work with him to specifically determine in the signed contract exactly what wear and tear means, and what will get deducted from your security deposit. Great location, nice landlord, but just be very cautious to know what exactly you're getting into before renting from him. Another case in point, the summer that I lived there, two cars and two apartment units were broken into. Be cautious before renting from any unit at Waterworks! |
