[26-Jan-2023] Throughout my time (Oct 12, 2020 – Nov 30, 2022) as a tenant of Gibbon Pender (landlord), he displayed a pattern of dishonesty and a failure to fix necessary items in and around the single-family home I rented.
After Gibbon Pender’s failure to address the countless problems within his rental home, I mailed him a letter on June 26, 2022, which identified the items I requested he fix. On July 3, 2022, he responded to my letter in email. In it, refused to fix broken/cracked window or address pealing paint. He seemed shocked at my request to even have him fix these items.
In response to my letter, Gibbon Pender did come by the house, but he didn’t fix anything. The intent of his visit was to convince me that he didn’t need to fix anything. I didn’t relent, but he never fixed any of the items on the list while I lived there. Many of the items I identified in my letter, are required to be fixed per NC General Statutes.
On October 20, 2022, I sent an email to Gibbon Pender informing him of my intention to terminate the lease. In his response, he claimed that I had to give him 60 days-notice as part of our month-to-month lease. Mr. Pender either didn’t read our agreement or hoped that I hadn’t read it when he implied that I would owe him an additional month of rent. His claim of 60 days-notice appeared to be an attempt to extract additional money out of me for which he was not legally entitled.
On December 28, 2022, Gibbon Pender sent me an email giving me the status of my security deposit. He indicated that he would be withholding over $1,000 from my security deposit, mainly for yard work. I found the amount of money charged for yard work, on a yard I maintained for the two+ years, to be excessive. Regardless, I chose to not dispute the charges and only request he provide me documentation of such in the form of a receipt.
In his response on December 28, 2022, he stated, “I just had the yard cleaned for $975.” He very clearly used the past tense, indicating the yardwork was complete. I was not in Hendersonville, NC to inspect the property, but I had a hunch that the work had not been done. Thus, he charged me almost $1,000 for work not completed. I continued to request documentation of said work, but he failed to provide it. Gibbon Pender attempted to divert my questions and avoid answering whether or not the work was actually complete. Finally, on January 6, 2023, Gibbon Pender emailed me admitting that the work was just completed on January 5, 2023. This demonstrated that Gibbon Pender had lied to me and attempted to withhold my security deposit without having completed the underlying work. Had I not continually pushed him to provide an invoice, would the work have ever been completed? Would he have simply taken my money?
His failure to fix items he was legally required to fix coupled with his dishonesty, cause me to discourage anyone from renting a home with Gibbon Pender.
