This acceptable use policy is intended to ensure that
ratemylandlord.com services remain useful for all.
Non-Commercial Use. ratemylandlord.com accounts and services are for individual, non-commercial use only.
Products and Services. Reference to any product or service herein must not be
construed as an offer of such product or service.
Allowable Use. ratemylandlord.com services may only be used for lawful purposes.
Transmission of any material in violation of any federal or state statute or regulation
is prohibited. This includes, but is not limited to, copyrighted material,
material legally judged to be threatening or obscene, or material protected by
trade secret. You agree to indemnify and hold harmless ratemylandlord.com from any claims
resulting from your use of ratemylandlord.com services.
Any and all shell access accounts provided by ratemylandlord.com may only be used interactively.
They may not be used to run unattended processes including, but not limited to, any
IRC bot, cron job, or screen.
Email that is left on the email server will be automatically deleted after 90 (ninety) days
of nonaccess. Email that has been read must be removed from the email server.
All email accounts are subject to the same restrictions and policies of access accounts.
Commercial advertisements are not allowed in ratemylandlord.com forums.
Commercial advertisements are not allowed in email sent to ratemylandlord.com email addresses,
unless the recipient has specifically and explicitly requested the advertisement.
Commercial advertisements are not allowed in email sent from ratemylandlord.com email addresses,
and will result in account suspension or cancellation.
Commercial advertisements are unwelcome in most usenet discussion groups and on
most email mailing lists. Inappropriate posting may result in account suspension or
cancellation. See the newsgroup or mailing list's charter to determine whether advertising
is allowed or not. Cross posting, or sending a message to many different off-topic
newsgroups, is particularly unacceptable and will be treated as such. Sending a message,
especially an advertisement, is by itself spamming unless the individual has specifically
requested information. The spamming of one recipient is considered UCE, or unsolicited
commercial email. UBE, or unsolicited bulk email is when there is multiple recipients of
UCE. UBE is especially erroneous and will be treated as such by ratemylandlord.com.
Email is a person-to-person medium, not a broadcast medium.
You agree to abide by ratemylandlord.com policies concerning use of ratemylandlord.com
services. Unsolicited advertisements via email, or via discussion groups whose charter
does not explicitly allow advertisements, is specifically not an allowable use.
ratemylandlord.com reserves the right to suspend access to service for your account(s)
upon an indication of disallowed use.
You further agree not to use ratemylandlord.com and/or
its interfaces or data to enable high volume, automated or robotic electronic
processes designed to collect or compile data for any purpose,
including mining this data for your own personal or commercial purposes.
Responsibility for Account Use. You are responsible for all use of your
account(s) and confidentiality of password(s). ratemylandlord.com will suspend or change
access upon notification that your password has been stolen, lost or otherwise
possibly compromised. ratemylandlord.com is not responsible for any of your personal files
which may reside online on ratemylandlord.com-owned and controlled computers.
You shall be responsible for independent backup of your data stored online.
Unauthorized Use of Account. ratemylandlord.com will strongly react to any use
or attempted use of an account or computer without the owner's authorization.
Such attempts include "social engineering" (tricking other people into releasing their passwords),
password cracking, security hole scanning, denial-of-service attacks (ping-flooding,
sending packets with an illegal packet size, udp flooding, half-open tcp connection
flooding, etc.) and the like.
Harassment or abusive use of email and other services is serious.
ratemylandlord.com will handle incidents of harassment on a
case-by-case basis, consulting with all parties involved, and reserves the right to
release customer information to the proper authorities should it discover unlawful activity.
Any unauthorized use of accounts or computers by a ratemylandlord.com member, whether or not the
attacked account or computer belongs to ratemylandlord.com, will result in action against the attacker.
Possible actions include warnings, account suspension or cancellation, and legal action,
according to the seriousness of the attack.
Limitations on Resource Usage. ratemylandlord.com reserves the right to impose
limits on the total amount of disk space and other resources available for your
use on ratemylandlord.com-operated computers.
For any web service which may be provided by ratemylandlord.com, members may not use
the web space for purposes that can be deemed as an attempt to sell or market a
product or service. This space has been provided for an individual's personal,
non-commercial use only. Any attempt to use this space for business use is in direct
conflict with the terms of this acceptable use policy.
Email Privacy. Electronic mail passes through multiple mail servers on
the internet as it passes from source to destination. One can never be guaranteed
privacy from every possible mail server; therefore, someone seeking total privacy
should use some encryption scheme to render their messages unreadable by
eavesdroppers. ratemylandlord.com places
a high value on privacy, and will only examine users' email when absolutely required
(for example, when troubleshooting email delivery problems or when presented with a
search warrant for the information.)
Illegal Material. ratemylandlord.com bears certain legal liabilities for the use
of its computer network and equipment. As such, ratemylandlord.com must require that its customers
do not use the ratemylandlord.com network for illegal purposes. When presented with a
search warrant, ratemylandlord.com is obligated to release any information named therein,
and will cooperate with the authorities in any criminal investigation of
inappropriate Internet usage.
You understand that all postings, messages, comments, text, files, images, photos, video, sounds, or other materials
("content") posted on, transmitted through, or linked from the ratemylandlord.com service, are the sole
responsibility of the person from whom such content originated. More specifically, you are entirely responsible
for all content that you post, email or otherwise make available via ratemylandlord.com. You understand that
ratemylandlord.com does not control, and is not responsible for content made available through its services,
and that by using the ratemylandlord.com service, you may be exposed to content that is offensive, indecent,
inaccurate, misleading, or otherwise objectionable.
ratemylandlord.com will not edit
your posts in the forums or your comments in the landlord ratings under any circumstance. You own your own words,
and you are responsible for what you say.
ratemylandlord.com may, at its discretion, delete content. Following is a non-exhaustive list of material that is
inappropriate and subject to deletion at any time:
ratemylandlord.com's failure to delete material does not constitute any form of approval of that material,
nor a modification of this policy. ratemylandlord.com reserves the right to delete any message in this
forum for any reason whatsoever.
- Obscene or vulgar language;
- Pornography and obscenity, or any sexually-oriented material;
- Abusive, harassing, or bigoted speech
that harasses, degrades, intimidates or is hateful toward an individual or
group of individuals on the basis of religion, gender, sexual orientation,
race, ethnicity, age, or disability;
- Material which ratemylandlord.com believes to be copyrighted, proprietary, or to contain trade secrets;
- Private information regarding individuals, or material that seems aimed at embarrassing or harassing individuals or invading their privacy;
- Chain letters, pyramid schemes, solicitations,
affiliate marketing, link referral codes, junk mail, spam, or other unsolicited commercial advertisements;
- Irrelevant or off-topic material;
- Repeated posts ("floods");
- Posts likely to or apparently aimed at disrupting the forum;
- Links to any of the above;
- Content that impersonates any person or entity, including, but not limited to, a
ratemylandlord.com member or ratemylandlord.com employee;
- Content falsely stating or otherwise misrepresenting your identity or
affiliation with a person or entity.
At its discretion, ratemylandlord.com may revoke the access privileges of any individual, either temporarily or permanently.
However, ratemylandlord.com recognizes that the legal status
of the internet is evolving, both through legislation and court precedent.
Therefore ratemylandlord.com must make certain decisions regarding the illegality of
various specific actions. Among the actions ratemylandlord.com considers illegal and
therefore not allowed on its network are: unauthorized distribution of copyrighted
material; exploitation of minors; unauthorized use of computer resources. ratemylandlord.com
believes that the first amendment rights of free speech, freedom of the press, and
freedom of association apply to the internet to the same degree as they do to print media,
and that any attempt to infringe upon those rights is void of legitimacy.
Self Rating. Landlords are not allowed to rate themselves.
Web Service. ratemylandlord.com services may include web service. In all cases,
the web pages reside on ratemylandlord.com computer equipment, giving ratemylandlord.com some
ethical responsibility for the content of such pages. ratemylandlord.com will handle potentially
inappropriate web pages on a case-by-case basis.
At its discretion, ratemylandlord.com may grant you a nonexclusive, nontransferable, limited license to store
documents on a ratemylandlord.com world wide web server, and to use the server
at burst bandwidth speeds up to ratemylandlord.com's full capacity.
Domain Name Service. You are responsible to the domain name registrar
for any fees they may charge.
Term and Termination. This agreement shall become effective on the earlier of the
date the service application is entered into ratemylandlord.com systems or the end of one
business day after receipt of application. With respect to any free service, this agreement shall
become effective upon first use of such free service.
ratemylandlord.com, at its sole discretion, may
terminate this agreement immediately or suspend your access to the service upon any
breach of this agreement by you.
For your protection, ratemylandlord.com requests that all cancellation notices be via email to
or otherwise in writing. You are responsible for notifying ratemylandlord.com
of your wish to terminate your account.
If applicable, any charges will continue to accrue
until your notification to ratemylandlord.com of account termination, or until your account
is suspended due to late payment. After two billing periods of nonpayment, ratemylandlord.com will close your
account; you will then be required to re-subscribe, according to policies in effect at that
time, in order to continue service.
Licenses granted hereunder will terminate automatically if you fail to comply with the
limitations described herein.
Effect of Agreement. This agreement, which shall include the current and future
schedules hereto, represents the complete agreement concerning this license between the
parties and supersedes all prior agreements and representations between them.
Modification of Terms and Charges. ratemylandlord.com reserves the right to modify
provisions of this agreement by notifying you via written or online notice at least 30 (thirty)
days before the effective date of the change. Your use of ratemylandlord.com's
services after such notice shall constitute your acceptance of the
modifications to this agreement.
Disclaimer of Warranties. You agree that use of the ratemylandlord.com site and its
services is entirely at your own risk. The ratemylandlord.com site and its services are provided on an "as is"
and "as available" basis, without any warranties of any kind. All express and implied warranties, including,
without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement
of proprietary rights are expressly disclaimed to the fullest extent permitted by law. To the fullest extent
permitted by law, ratemylandlord.com disclaims any warranties for the security, reliability, timeliness, accuracy,
and performance of the ratemylandlord.com site and its services. To the fullest extent permitted by law,
ratemylandlord.com disclaims any warranties for other services or goods received through or advertised
on the ratemylandlord.com site or its services, or accessed through any links on the ratemylandlord.com
site. To the fullest extent permitted by law, ratemylandlord.com disclaims any warranties for viruses or other
harmful components in connection with the ratemylandlord.com site or its services.
Some jurisdictions do not allow the disclaimer of implied warranties. In such jurisdictions,
some of the foregoing disclaimers may not apply to you insofar as they relate to implied warranties.
Limitations of Liability. Under no circumstances shall ratemylandlord.com be liable for

Force Majeure. ratemylandlord.com's performance hereunder is subject to
interruption and delay due to causes beyond its reasonable control such as acts of
nature, acts of any government, war or other hostility, civil disorder,
explosion, power failure, equipment failure, industrial or labor disputes,
inability to obtain necessary supplies and the like.
Severability. If any provision of this agreement is held to be unenforceable
for any reason, such provision shall be reformed only to the extent necessary to make
it enforceable, and all other provisions are unaffected.
Indemnity. You agree to indemnify and hold ratemylandlord.com, its officers,
subsidiaries, affiliates, successors, assigns, directors, agents, service providers,
suppliers and employees, harmless from any claim or demand, including reasonable attorney fees
and court costs, made by any third party due to or arising out of content you submit, post or
otherwise make available through ratemylandlord.com or its services, your use of the services,
your violation of the Acceptable Use Policy, your violation of the SPAM policy,
your breach of any of the representations and warranties herein, or your violation of any rights of another.
Violation of Policies. Please report any violations of the Acceptable Use Policy
or the SPAM Policy by sending email to
Our failure to act with respect to a violation by you or others does
not waive our right to act with respect to subsequent or similar violations.
You understand and agree that, because damages are often difficult to quantify, if it
becomes necessary for ratemylandlord.com to pursue legal action to enforce the Acceptable Use Policy or the SPAM Policy,
you will be liable to pay ratemylandlord.com the following amounts as liquidated damages, which you accept
as reasonable estimates of ratemylandlord.com's damages for the specified breaches of the specific policy:
a. If you post a message that (1) impersonates any person or entity or (2) falsely states or otherwise misrepresents
your affiliation with a person or entity
you agree to pay ratemylandlord.com five thousand dollars ($5,000 USD) for each such message.
b. If you post any unauthorized commercial messages you agree to
pay ratemylandlord.com five thousand dollars ($5,000 USD) for each such message.
c. If ratemylandlord.com establishes limits on the frequency with which you may access ratemylandlord.com services, or terminates your
access to or use of the services, you agree to pay ratemylandlord.com five hundred dollars ($500 USD) for each message posted
in excess of such limits or for each day on which you access ratemylandlord.com in excess of such limits, whichever is higher.
d. If you send unsolicited email advertisements to ratemylandlord.com email addresses or through ratemylandlord.com computer systems,
you agree to pay ratemylandlord.com fifty dollars ($50 USD) for each such email message.
e. If you post messages in violation of the Acceptable Use Policy or the SPAM Policy, other than as described above, you agree
to pay ratemylandlord.com five hundred dollars ($5,000 USD) for each such message.
f. If you aggregate, display, copy, duplicate, reproduce, or otherwise exploit for any purpose any content (except for your own content)
in violation of the Acceptable Use Policy or the SPAM Policy without ratemylandlord.com's express written permission,
you agree to pay ratemylandlord.com five thousand dollars ($5,000 USD) for each day on which you engage in such conduct.
Otherwise, you agree to pay ratemylandlord.com's actual damages, to the extent such actual damages can be reasonably calculated.
Notwithstanding any other provision of the Acceptable Use Policy or the SPAM Policy, ratemylandlord.com retains the right to seek
the remedy of specific performance of any term contained in the Acceptable Use Policy or the SPAM Policy, or a preliminary or permanent
injunction against the breach of any such term or in aid of the exercise of any power granted in the Acceptable Use Policy or the SPAM Policy,
or any combination thereof.
Governing Law. This agreement shall be governed by and construed under the
laws of the state of California, except as governed by federal law.
Waiver. Failure of any party to enforce any provision of this agreement
shall not constitute or be construed as a waiver of such provision or of the right
to enforce such provision.
